Digital Downloads / ringtones (mono and poly) / truetones (“Content”). All Content provided and sold by Soundbuzz by means of electronic download to customers shall not be refunded. There shall also be no cancellation of any orders for Content once the order has been placed and the payment process has commenced.
Soundbuzz may at its sole discretion allow refunds in the event that a download is unsuccessful. The refund request must be sent to our Customer Service Center at support@soundbuzz.com citing the reasons for the inability to download. If a refund credit has been processed by Soundbuzz but does not appear on your credit card, please contact the bank that issued your credit card.
In the event that a successfully purchased track has been lost by a customer as a result of a crash of the customer’s hard drive or such similar occurrence, Soundbuzz may re-issue the customer’s license so as to enable the customer to re-download the track. This right to re-issue however, is reserved to Soundbuzz at its sole discretion.

Soundbuzz reserves the right, at any time, to change the price and billing methods of the Digital Downloads. For the avoidance of doubt, the prices, promotions, bundles or advertisements posted on the Website by Soundbuzz is an invitation to treat and shall not in anyway constitute or be interpreted as an offer by Soundbuzz to you.
5. Billing/ Payment Method and Refunds
All payment for your purchase(s) must be made by MasterCard, VISA, VISA DELTA or American Express. We will only process payments where we can verify that your billing address is within the Allowed Territories and/or where your method of payment, namely the abovementioned credit cards, originate from a bank within the Allowed Territories. All payments are processed by WorldPay and all terms and conditions of WorldPay shall apply. We currently do not accept cash, checks or any other payment form, however we may change this policy in the future. To the extent permitted by law, you will also be responsible for payment of any unauthorised sum charged to your card by a third party. Except where expressly provided, Soundbuzz does not accept any cancellation of orders or refund any payment made for your purchase of the Digital Downloads. 6. No Warranties
6.1The Website provided to you on an "as-is" and "as available" basis without warranties of any kind, and Soundbuzz hereby disclaims all warranties, whether express or implied, including but not limited to: (a) uninterrupted, error-free, virus-free or continuous availability of the service and Website; and (b) implied warranties of merchantability, fitness for a particular purpose and non-infringement with respect to the service and Website and any services provided by Soundbuzz hereunder.
6.2 Soundbuzz disclaims to the fullest extent allowed under applicable law, any and all liability for the acts, omissions and conduct of any third parties in connection with or related to your use of the Website or the services. You assume complete responsibility for your use of the Website and any linked sites. Your sole remedy against Soundbuzz for dissatisfaction with the Website or any Content is to stop using the Website or any such Content.

11. Termination
Soundbuzz reserves the right to terminate your ability to access this site via your Log-In Details or cease providing you with the Digital Downloads and services herein in the event of your breach or suspected breach of any of the terms and conditions herein, without any liability to you whatsoever.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Singapore.

Soundbuzz reserves the right, at its sole discretion, to modify or revise all or any part of this EULA at any time without further notice to you. Any modification or revision of this EULA will be made accessible from the page "Legal Notices", which may be accessed from the homepage of the Website. By purchasing and downloading the Digital Downloads, you agree, represent and warrant that (a) the Digital Downloads are for your personal non-commercial use; (b) you will comply with and will not in any way circumvent or attempt to circumvent the Usage Rules or any technology designed to enforce the Usage Rules; and (c) you will not (nor attempt to) tamper with or modify the Digital Downloads.
Permitted Use:
Licenses - You are only allowed to store each Digital Download on 1 PC of your choice (1 "License"). However, as part of our customer support policy, Soundbuzz may, at its sole discretion, allow you up to two 2 times re-installation (i.e. 2 additional Licenses) within a 1 year period from the initial download of a Digital Download, in the event that you upgrade your operating system or suffer any hard drive crashes. Please contact our customer support at support@soundbuzz.com in the event that you wish to request for additional Licenses.
The number of "Burns" and "Ports" (defined below) permitted are in respect of each License granted per Digital Download.
Burns (i.e. CD burning) - You may "burn" each Digital Download up to 3 times only onto CD-R and/or CD-RW in order to create an audio compact disc in "Compact Disc - Digital Audio" Red Book format which is playable on an audio compact disc compatible player (3 "Burns").
Ports - You may export or transfer each Digital Download up to 3 portable media player devices that are compliant with Windows Media Digital Rights Management solution with security level set to "1000" an unlimited number of times to each such portable device. For the avoidance of doubt, all transfers to portable devices are only enabled for a one-way transfer to each such device and are not transferable from such device to other devices, PCs or other digital media. (3 "Ports").
Prohibited Use:
Save as provided herein, you further agree that you will not do or attempt to do any of the following:-
(i) Make any unauthorised copies of the Digital Downloads in any media;
(ii) Modify or create any derivative works of the Digital Downloads;
(iii) Alter, tamper with or remove any copyright notice, trademark, logo, symbols or such other labelling as may be featured with the Digital Downloads, or any copy protection devices, digital rights management or digital watermark embedded within the Digital Downloads.
The Digital Downloads shall only be for your personal, non-commercial use.
The delivery of a Digital Download does not transfer to you any commercial or promotional use rights in the Digital Download.
More Restrictive Usage Rules by Different Licensors:
As certain labels and licensors of the Digital Downloads may require stricter usage rules than the Usage Rules specified herein, Soundbuzz will, where applicable, identify these more restrictive usage rules prior to your purchase of a Digital Download that is subject to any more restrictive usage rules.
Intellectual Property Rights
All content including all media, software, text, images, graphics, user interfaces, music, videos, photographs, logo, artwork and other content on the Website including without limitation the design, selection, arrangement and coordination of such content is owned or licensed by or to Soundbuzz, and is protected by copyright, trademark and other intellectual property rights laws. For the avoidance of doubt, the title and copyright in and to the sound recordings embodied in the Digital Downloads remain vested with the original copyright owner/ licensor, and your license herein to use the Digital Downloads (including any Burning or Porting capabilities of such download) does not affect the underlying intellectual property rights in and to the sound recordings of said Digital Downloads, nor shall it constitute a grant or wavier of any rights of the relevant copyright owners. Any use of the Digital Download including the sound recording embodied therein other than as permitted above is a violation of this EULA and any applicable copyright laws and is hereby prohibited.
